Ranting and making myself feel better

So today I came to a few realizations: 1)My world is totally going to go to crap this week because if I don't pay the gas bill by the 24th they are going to turn off the gas, my cell phone will be turned off again this week because I can't pay the bill, the insurance for my car will be canceled because I can't pay it, etc; 2) My mom wants to go through the temple on Friday and I won't be able to be there or call her to congratulate her; and 3)my contract is up in less than 15 days and I don't have money for a new contract for the apartment I want to move to or even to renew at this crappy apt. I went to Red Deli on Thursday and get this he was actually there and he told me how his check bounced for the security deposit, how he can't pay me until he finishes paying off other employees and current bills and I felt like he didn't care that my bank out is in the whole and getting bigger everyday. I wrote him a letter tonight because he will probably not be there when I go by tomorrow morning and Monday I will go to Depart of workforce management and report him. I don't want him to lose his business and I have tried to be patient but I totally feel like he is blowing me off. Although I am glad that I sat down and calculated things and he actually owes me $3600 and not the $3200 I was thinking and I am sure if I gave my hours to workforce management they may come up with an even higher about like $4000 or $4200. He thinks that I didn't start until Sat March 15th because that was the first full day I worked but I actually started on March 13th and we had an agreement because I needed to finish out the week where I worked that I would only work part of the day on the 13th and 14th. Unfortunately it was a verbal agreement and we both walked away thinking something different. He thought I worked those 2 days for free and I thought I was just working less those 2 days. That was back in April when he paid me and that should have been a red flag for me or the letter that I read from a past store manager on his desktop that stated the same thing only that guy his whole training was suppose to be free (like 2 weeks), but no I just said he has changed and things will be better for me and I will get paid. Man was I in lala land. But now I hope that I am taking the steps the Lord wants me to take so that I can get a job so that I can get out of the whole and pay my bills and get a place to live. If I have to have to have 2 part jobs instead of a full time job so be it. I hear about a job early next week and that would be 9 am to 1 pm and then if I get the baker job at the Lion House in Salt Lake that would start at 3. One would be 20 hours a week and one would be 32 and with the different pay I would be making about $9 /hr which is fine as long as has I have something.

Sweetheart, I know you don't want to, but I think you should look into taking this guy to small claims court for not just the lack of pay you received, but also for all the fines you've had to pay because you couldn't pay your bills (and would have been able to pay them if you had been paid in a timely matter). There is probably some "pain an suffering" compensation due there too, for making you miss your mom's temple endowment and ruining your credit, etc. I know you feel sorry for the guy, but starting a business was HIS risk. Just as an employee doesn't get a cut of the profits, she doesn't get a cut of the losses either. Your ex-boss has given you an unjust cut of the losses just to prevent him from having to take out another business loan. His debts are HIS problems. It's the risk he agreed to take when he started the business. You were hired not as a partner, but as an employee. You get paid for your work no matter how much debt he has to go into to pay you. What he is doing to you is wrong--DEAD WRONG, and no amount of reasoning on his part (or yours) can justify it.

Collect all the evidence you can for your hours worked. Make a record of each attempt you made to get paid. Keep copies of letters. Gather together all your bills, late notices, etc. that you need to prove how much his not paying you has cost you. Counsel with workforce management, but also look into BYU mediation if you can. It might be a hassle getting ready and going to small claims court, but this guy is about to make you homeless. You need to stand up for your rights. He owes you far more now than just the $3600 in pay.
